DELAY OF A CONSUMER PROTECTION PROVISION OF THE AFFORDABLE CARE ACT

On July 2, 2013, the Obama administration surprised everyone by announcing a delay in the “play or pay” provision of the Affordable Care Act (“ACA”) until 2015. Attention is now being given to the delay of another provision of the ACA - the consumer protection provision that limits annual out-of-pocket costs for individuals and families. The provision places an overall limit on annual costs for deductibles, co-payments, and co-insurance of $6,350/year for individuals and $12,700/year for families, under Section 1302(c)(1)of the Act.
